Prop 65 Labels
California Proposition 65, officially known as “The Safe Drinking Water and Toxic Enforcement Act,” requires businesses to provide warnings to consumers and employees in California before knowingly and intentionally causing significant exposures to certain chemicals known to cause cancer or reproductive toxicity. The list of chemicals to be warned about currently contains more than 850 types, ranging from naturally occurring to synthetic chemicals. Listed chemicals may also be used in manufacturing and construction, or they may be byproducts of chemical processes, like motor vehicle exhaust.
While Proposition 65 went into effect decades ago, in 1986, its recent amendments impose stricter requirements that take effect August 30, 2018. The latest Proposition 65 requirements mean that warnings must be more explicit – fully identifying the chemical and providing specific information about how a person may be exposed or ways to reduce or eliminate exposure. Penalties for violating Proposition 65 by failing to provide these types of warnings can be as high as $2,500 per violation per day.
